Orka Sauna – Terms & Conditions
These Terms & Conditions apply to all bookings with ORKA SAUNA, located in Burghead, Scotland. By booking a session, you agree to the following:
- Bookings & Payments
- Full payment is required at the time of booking to secure your session.
- Bookings are non-transferable without prior agreement.
- Gift vouchers must be presented at the time of booking.
- Minimum age – 16 years +
Cancellations & Refunds
- Cancellations made 48 hours before your booking will receive a full refund
- No refund within 48 hours
- Orka Sauna reserves the right to cancel or reschedule if conditions are unsafe (eg, High winds, storms, extreme tides) or circumstances beyond our control, you will be offered either:
- Rescheduled date or
- Full refund
Health & Safety
- Use of sauna is at your own risk.
- All customers must sign a health waiver form before attending
- Any customer who is under the influence of alcohol or drugs is not permitted to use the sauna. If you are suspected of being under the influence, entry will be refused and no refund given.
- If you have any medical conditions (eg heart problems, pregnancy, respiratory conditions) you should consult a doctor before use.
- Sea dipping/cold plunge is entirely at your own risk. Sea dipping/cold plunge is not covered under our insurance policy. Always enter the sea responsibly and be aware of the dangers of local tides, offshore winds and cold water shock.
- Follow all instructions given by Orka Sauna staff.
Customer Responsibilities
- Please arrive 10 minutes before your session for your health & safety brief. Late arrival may shorten your booking time.
- Please ensure you are appropriately dressed (swimsuit/shorts) Orka Sauna is not a nude sauna.
- You are responsible for your personal belongings Orka Sauna accepts no liability for loss or theft.
Liability
- Orka sauna accepts no liability for injury, illness, or loss arising from the use of our sauna, except when caused by our negligence.
- Participation in using the sauna and sea dipping/cold water plunge is done so entirely at your own risk and is not covered under our insurance policy.
Behaviour & Respect
- Orka sauna operates a zero-tolerance policy towards abuse, harassment, or aggressive behaviour towards staff or other guests.
- Anyone behaving inappropriately will be asked to leave, with no refund given.
- We reserve the right to refuse future bookings from anyone who breaches this policy.
Force Majeure / Weather & Natural conditions
- Orka Sauna is not liable for changes to session times, delays or cancellations caused by circumstances beyond our control, including storms, high winds or unsafe sea conditions.
Governing Law & Jurisdiction
- These Terms & Conditions are governed by the law of Scotland.
- The Courts of Scotland have exclusive jurisdiction arising from these Terms & Conditions.
Changes to Terms
Orka sauna may update these Terms & Conditions at any time. The latest version will always be available on our website.
Complaints Policy & Procedure
We aim to provide all guests with a high quality and enjoyable experience. If you are unhappy with any aspect of your visit, please let us know so we can put things right.
How to raise a complaint
- In the first instance, please speak to a member of staff during your visit so we can try and resolve the issue immediately.
- If the matter cannot be resolved at the time, you may submit a written complaint by email to – info@orkasauna.co.uk
How we will respond
- We will acknowledge your complaint within 5 working days
- A full investigation will be carried out, and we aim to provide a written response within 14 working days.
Our commitment
- All complaints will be handled fairly, sensitively, and in confidence.
- Where appropriate, we will offer a remedy such as an explanation, apology, reschedule, or refund in line with our cancellation policy and the circumstances following our investigation.
Data Protection
- Orka Sauna collects and processes personal information, such as your name, contact details, and booking information, in line with the UK General DataProtection Regulation (UK GDPR)and the Data Protection Act 2018.
- We only use your information to manage bookings, provide services, and communicate with you regarding your booked session.
- Your information will not be shared with third parties, except when required by law.
- We retain personal data only as long as necessary for business and legal purposes.
- You have the right to request access to, correction of, or deletion of your personal data at any time by contacting us at info@orkasauna.co.uk
Photography & Social Media
- By attending Orka Sauna, you consent to photography/video for promotional purposes unless you notify staff otherwise.
Intellectual Property
- All content on the Orka Sauna website, social media, and promotional materials, including text, images, videos, logos, and branding is the property of Orka Sauna or used with permission.
- You may not copy, reproduce, distribute, or create derivative works from any content without prior written consent.
- Attending Orka Sauna does not grant any rights to use our brand or materials for commercial purposes.
- Unauthorised use of Orka Sauna’s intellectual property may result in legal action.
